Tournament Terms, Conditions & Waiver
1. Participants and Responsibility
Individuals: Participants, or their parent or legal guardian if under 18, are solely responsible for their participation in the event.
Teams: The coach and their affiliated club, school, or organization are responsible for all players, coaches, and spectators associated with the team.
2. Assumption of Risk
Participation in basketball and related athletic activities involves inherent and unavoidable risks that may result in serious injury, illness, disability, or death.
These risks include, but are not limited to: falls, collisions with other participants, contact with equipment or surfaces, overexertion, environmental conditions, and other inherent or incidental risks associated with athletic participation, including risks arising from the ordinary negligence of Amity Sports LLC, event staff, volunteers, referees, host facilities, or other participants.
By participating, all participants voluntarily assume all risks, both known and unknown, associated with participation.
3. Release of Liability (Waiver of Claims)
To the fullest extent permitted by Oregon law, participants, coaches, teams, and/or parents or legal guardians on behalf of minors hereby release, waive, and discharge Amity Sports LLC, host schools, school districts, facility owners, and all employees, staff, volunteers, referees, contractors, and representatives (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, or liabilities of any kind arising out of or related to participation in the event.
This release includes, without limitation, claims arising from the ordinary negligence of the Released Parties.
4. Medical Certification
Individuals certify that they, or the minors for whom they are registering, are physically and medically fit to participate in athletic activity and voluntarily choose to participate.
Participants acknowledge that they are responsible for any pre-existing medical conditions and understand that participation may pose risks even if such conditions are known or unknown.
Teams: By registering, the coach certifies that all team members are physically capable of participation and understand the voluntary nature of participation.
5. Rules, Conduct, and Disqualification
All participants, coaches, and spectators agree to comply with all rules, policies, and decisions made by Amity Sports LLC.
The Company reserves the right to remove, disqualify, or prohibit participation of any individual or team at its sole discretion for misconduct, unsafe behavior, or rule violations, with or without refund.
6. Scheduling, Format, and Operations
Amity Sports LLC reserves the right to modify schedules, divisions, formats, rules, or structure of the event at any time as necessary for operational, safety, or logistical reasons.
7. Indemnification
Participants, teams, coaches, and/or parents or legal guardians agree to indemnify, defend, and hold harmless Amity Sports LLC, host schools, school districts, facility owners, and the Released Parties from any claims, liabilities, damages, costs, or expenses (including attorney fees) arising out of participation in the event or violation of these Terms.
8. Property Damage
Participants, teams, coaches, and spectators are responsible for any damage to facilities, equipment, or property caused by their actions during the event.
9. Minor Participation and Parental Waiver
If registering a participant under the age of 18, the parent or legal guardian confirms that they have full legal authority to do so and expressly:
Authorize participation in the event, and
Release, waive, and discharge all claims on behalf of the minor, including claims arising from the ordinary negligence of the Released Parties.
The parent or legal guardian further agrees to assume all risks associated with the minor’s participation.
10. Severability
If any provision of this Agreement is found to be unenforceable or invalid under applicable law, the remaining provisions shall remain in full force and effect.
11. Entire Agreement
This document constitutes the entire agreement between the parties regarding participation in the event and supersedes any prior or contemporaneous understandings, communications, or representations.
